In the matter of a change in the Moss hill and Kirchem's mill road : In the matter of the: report of W M Stone, James Fullam, and Geo. Hicen botham, viewers appointed at the last term of thin board to view and locate a county road situated in Clackamas county, Oregon and described in full on page 34 of this journal, said viewers filed their report showing that they had met on the 9th day of May J801, a day named in the notice served upon them and were duly sworn by subscribing to a written oat h ol office administered by John W Meldrum deputy county surveyor, after wlvch they proceeded to the designated place and did view and cause to be sur veyed by said deputy county surveyor the above described road ; they also filed the field notes and plat ot the survey. Said viewers report favorably to the es tablishing of said road as viewed and surveyed for the reasons that it is a good practical route and of public utility. It is ordered and adjudged that the field notes and plat of the survey be recorded in all respects approved and that the expense of said view and survey be paid by Clackamas county and the clerk is hereby ordered to Isue the necessary notice to the supervisor of said district or districts in which said road lies to open and work the same. This matter coming on and it appear ing to the board, that August Hubert and Mary Hubert here made, executed and delivered to Clackamas county, a deed to a strip of land in sec 28 T 3 S R 3 E, for a public highway, such land having been duly surveyed by John W Meldrum, deputy county surveyor, and he Laving filed the field notes and plat or said survey, It is ordered that said deed be recorded and that the field notes and plat of said survey be recorded and said land be established as a public high way and that the supervisor of said dis trict be ordered to opeo the same for travel. In the matter of . the Culick road : This matter coming on and the board being fully advised, it is ordered that J E Burnett, supervisor of road district No 4, open and work the Culick road at what is known as Linn's Hill in said district No 4. , In tbe matter of scalp bounty warrants : This matter coming on upon written petition presented by A Luelling, county treasurer, showing that tbe first warrants issued upon the scalp bounty fund, were issued and paid out of the general fund before the session laws were issued and distributed to the county officers. But it appears from the law that such war rants shall be paid out of the general fund in the Bame manner as other county warrants. Therefore, it is ordered that said warrants so issued and numbered 1, 3, 4, 5, 6, 7. 8 and 9, amounting in the aggregate to the sum ot $34 be and heieby are cancelled, and that one warrant be issued in the name of Elmer Dixon in the sum of $34 instead of warrants num bered 1, 3, 4, 5, 6, 7, 8 and 9 and that said warrants be sold and said sum of $34 be placed in the general fund in the county treasury. In the matter of poll tax rebate of Mathias Kandle: This matter coming on upon written petition and the Board beinir fnllv Ad vised, It is ordered that Mathias Kandle i have a rebate of poll tax for the vear 1899, amounting to $3. I In the matter of the petition of I W Johnson for a rebate of double assess ments: This matter coming on upon written petition filed herein and the Board being fully advised, It is ordered that the sale of Reuben Root's acre in Marshfield for the year 1899 be, and the same is hereby cancelled. Assignment of tax certificate of Jennie E Curry: It is orderod that the clerk be and he is hereby ordered to assign to E F Riley, the claim of the county against Jennie E Curry for taxes on lots in Marchbanks. So far as the same is shown on the list made up by the clerk lor sales on 1st Monday in July 1901, upon payment by said Riley of the amount shown in said list. In the matter of the care and keeping of David Mortmeir a county charge: It is ordered that David Mortmeir, a county charge, be placed in the care and keeDlno? of Elias Miller. In the matter of John H Churchill, an indigent soldier: This matter coining on and tbe board being fully advised it is ordered that John H Churchill, an indigent soldier have aid in the sum of $5 for the mouth of June 1901. In tbe matter ot plank on the High land road : This matter coming on for the consid eration of planking the Highland road trom Myers place in Milk Creek precinct and extending to Clarks in Highland precinct and the bourd being fully ad vised it is ordered that the contract be let to Cummins and Durst at the rate of $5 per thousand feet upon their signing' a contract and giving a bond in the sum of $800. In the matter of rebate of poll tax of TD Phelps: It is ordered that a rebate be made to T D Phelps of $3 erroneously paid by him as a poll tax for the year 1900 and that the clerk issue warrant for the same. Application ot Elizabeth Rees for a re bate on taxes : This matter coming on upon written petitipn of Elizabeth Rees by her attor ney Robert A Miller and it duly appear ing to tbe board that tbe assessment of Elizabeth Rees for the year 1899 was er roneous in the sum of $2 35, therefore it is ordered that Elizabeth Rees do have a rebate upon her taxes for the year 1S99 in the sum of $2 35 and that the clerk iss.ie warrant for the same. In the matter of reports of officers for the month of May 1901 : The officers having made their reports and the board haying examined their books and being fully advised, it is or dered that the same be and hereby is in all respects approved and accepted ; said reports show collections, as follows, lo- wit: County Clork $227 60 County Recorder 203 50 In the matter of the mileage and per diem of the county commissioners: It is ordered by the board that the mileage and per diem of the commis sioners be allowed as follows to-wit.
